Diddy's Attorney: 'I Don’t Know That I Could Keep Him Off the Stand'

Diddy is accused in a recently unsealed indictment of racketeering conspiracy, sex trafficking, and transportation to engage in prostitution.

Diddy’s attorney says his client is “very eager to tell his story” after being arrested in New York and named in an indictment alleging trafficking and racketeering.

Speaking with TMZ’s Harvey Levin in a soon-to-be-released Tubi documentary, as seen in this newly released clip, Marc Agnifilo was asked about the possibility of Diddy himself taking the stand at an eventual trial. Agnifilo not only made this sound quite likely, but he also pointed to “a story” he says only his client could tell.

“I don’t know that I could keep him off the stand,” Agnifilo said. “I think he is very eager to tell his story/ And I think he will tell every part of his story including what you see on the video. So I expect it’s going to be explained by the both of us.”

The video in question, of course, is the hotel surveillance footage from 2016 that was made public earlier this year. In it, Diddy, who later said he took “full responsibility for my actions” in the footage, was seen physically assaulting Cassie. Levin called the possibility of Diddy taking the stand “breathtaking,” adding that cross-examination could also see him being asked not only about that footage but also about details of what prosecutors have called “Freak Offs” and a previously reported accusation centered on an alleged car explosion.

“He has his story and he has a story that I think only he can tell in the way he can tell it, in real time,” Agnifilo responded. “And it’s a human story. It’s a story of love. It’s a story of hurt. It’s a story of heartbreak. I mean, when he describes that relationship the word he uses more than any other word is heartbreak. He was heartbroken. She was heartbroken.”

In a prior statement, Agnifilo called Diddy “innocent” and said he had been cooperative with regards to the much-publicized case.

“We are disappointed with the decision to pursue what we believe is an unjust prosecution of Mr. Combs by the U.S. Attorney’s Office,” Agnifilo said earlier this month. “Sean ‘Diddy’ Combs is a music icon, self-made entrepreneur, loving family man, and proven philanthropist who has spent the last 30 years building an empire, adoring his children, and working to uplift the Black community. He is an imperfect person but he Is not a criminal."

Agnifilo continued, "To his credit Mr. Combs has been nothing but cooperative with this investigation and he voluntarily relocated to New York last week in anticipation of these charges. Please reserve your judgment until you have all the facts. These are the acts of an innocent man with nothing to hide, and he looks forward to clearing his name in court.”

Meanwhile, the TMZ and Tubi doc isn’t the only one on the horizon. 50 Cent, who has long teased a docuseries about the allegations against Diddy, was confirmed just this week to be executive producing exactly that for Netflix.

The indictment against Diddy included charges of racketeering conspiracy, sex trafficking, and transportation to engage in prostitution. He has pleaded not guilty.
