Wendy Williams isn't mincing any words when it comes to the guardianship she's been locked in for years, calling the situation "very scary."

Williams and her attorney, Joe Tacopina, spoke with TMZ outside Fresco by Scotto in New York City Tuesday, July 22 as the two were leaving a birthday dinner to celebrate the TV host.

When asked what he hopes is next for Williams' situation, Tacopina says hopefully it's justice. The lawyer then goes on to shut down anyone who may think Williams' is not as mentally sharp as she used to be, adding, "Wendy’s Wendy, we’ve had conversations over the course of 6 months, she’s the same Wendy Williams we know from TV."

Then Williams, who recently celebrated her 61st birthday, chimed in, saying, "I just had a birthday and I'm still in a guardianship, if that doesn't say enough I don't know what does."

Tacopina, who recently successfully defended A$AP Rocky in his gun assault case, calls the entire guardianship process scary ... a sentiment echoed by Williams, who calls it, "Very scary."

As for holding those behind the guardianship responsible with possible lawsuits in the future, Tacopina certainly wasn't shy, saying there's "no question" he will take action. However, for now, he says his main priority is getting Williams back home.

One bright light though ... Williams credits her beauty at 61 to the fact all she does in her guardianship facility is work out.

Williams has been locked in a court-ordered guardianship since 2022 over concerns she's unable to manage her own affairs ... leaving decisions about Williams' health, finances and other affairs up to her guardian, Sabrina Morrissey.

Tacopina admits it won't be an easy battle to get Williams out of the situation, as it takes a lot of effort, but he wants to do everything he can to get his friend back to the life she was living before the guardianship was put in place.
